Court restrains INEC from recognising PDP convention results

The Federal High Court in Abuja has prohibited the Independent National Electoral Commission (INEC) from acknowledging or validating any results that may emerge from the planned national convention of the Peoples Democratic Party (PDP).

Justice James Omotosho while delivering his judgment on Friday in Abuja, held that the convention could not lawfully proceed, citing the party’s failure to meet essential legal and procedural requirements.

Justice Omotosho ruled that evidence presented by INEC and other respondents revealed that PDP did not conduct valid congresses in many states, thereby violating established regulations.

The judge further observed that official documents and notices signed solely by the PDP National Chairman, without the endorsement of the National Secretary, were invalid under the law.

Justice Omotosho noted that the party also failed to give INEC the required 21-day notice before holding meetings or congresses, denying the commission the opportunity to monitor such events as mandated by law.

The court concluded that PDP’s non-compliance with the legal provisions rendered its planned convention defective and unenforceable. 

It consequently ordered INEC not to accept, publish, or recognize any outcome from the proposed Ibadan convention until all legal conditions are fulfilled.
