Court restrains Prof. Utomi from forming “shadow government”‎



‎A Federal High Court sitting in Abuja has restrained the 2007 presidential candidate of the African Democratic Congress (ADC), Professor Pat Utomi, and any other person acting under his authority from further forming a shadow government.

‎Justice James Omotosho, the trial Judge, who delivered the judgement in the suit filed by the Department of State Services (DSS), ruled that establishing a shadow government is unconstitutional, null and void.

‎Justice Omotosho held that Sections 1(1) and 2 (1) of the 1999 Constitution are supreme and binding on all citizens, as the defendant is not entitled to his right of freedom of expression and association by forming a shadow government.
